Council and defendants agree to withdraw applications in relation to land west of Hovefields Avenue, Wickford

At a hearing in the High Court today (26 July) committal proceedings in relation to land west of Hovefields Avenue, Wickford, and a subsequent application from the defendants to strike out these proceedings were discontinued by mutual consent.

The decision followed preliminary observations of the Judge, His Honour Judge Gore QC, at the start of the hearing recommending both parties reconsider their positions.

This development follows a hearing last month where Mr Justice Singh ruled to allow travellers to stay on the unauthorised site under varied terms of the injunction order.

His Honour Judge Gore QC advised that court orders are there to be obeyed and that the court will take a dim view of any breaches of its orders.

He also informed the defendants that they must comply with Mr Justice Singh’s order dated 7 June 2017 and that any remaining disputes must be resolved in accordance with the law.

In light of this outcome the council will seek specialist legal advice on pursuing enforcement notices requiring residential use to cease and restoration of the land.
