Hearing date set following refusal of application to judicially review council’s decision

An oral hearing date has been set in relation to the decision by a High Court Judge not to permit an application to judicially review Basildon Council’s decision not to determine a traveller’s planning application.

The applicant, Michael Smith, has exercised his right to have this decision reconsidered at an oral hearing.

The hearing has been listed for Thursday 12 October for a 30 minute hearing at the High Court.

The time of the hearing will be confirmed by the court the day before the hearing.

On Wednesday 23 August His Honour Judge Waksman QC agreed with the council’s argument that its decision was lawful.

The council had strongly contested Michael Smith’s application to judicially review the council’s decision and was awarded all costs which amounted to around £5,000.
